1. Data Controller

Your personal data are processed by Ay Marka Mağazacılık Anonim Şirketi ("Company") with the legal status of data controller in accordance with the provisions of the Personal Data Protection Law No. 6698 ("KVKK") and within the framework of this Information Notice Regarding Membership and/ or Marketing Processes ("Information Notice") This Information Notice explains the scope of processing of your personal data collected within the framework of your membership ("Membership") to the loyalty / corporate membership programme(s) (e.g. Network Loyalty Programme (Netpoint Cards), Divarese Loyalty Programme (Select Cards), corporate customer) implemented by our Company and marketing activities.

2. Method of Collecting Your Personal Data

Your personal data are collected by our Company through fully or partially automated or non-automated means, provided that they are part of any data registry system, through physical and/or electronic media, through the internet sites of our Company, in particular www.network.com.tr and www.divarese.com.tr, Network and divarese mobile applications, our Company's electronic application portals, our Company's physical stores of our Company, dealers, call centre/ customer services, hand terminals, telephone, fax, mail / cargo, e-mail, SMS, inquiry/ complaint platforms, social media platforms, online meeting/ communication platforms including Company information technology systems, and internal integrated systems of the Company, integrated systems with authorized public entities and private entities, and other methods (channels) that may be added in the future.

  • Verification of membership information and updating information upon your request / requirement (e.g. Verification of telephone and e-mail addresses after membership, control of corporate e-mail address in corporate membership programmes).
  • Subject to compliance with the conditions of the relevant loyalty / corporate membership programme, planning and execution of the necessary activities in order for you to benefit from the benefits/ advantages/ campaigns/ discounts offered within the scope of the Membership (e.g. segment determination and correction, point earning, segment and/ or corporate membership-based benefits / advantages/ campaigns/ discounts for our members)
  • Planning and execution of customer satisfaction activities (e.g. sending gifts),.
  • Planning of organisations and events, determination of guest lists and communication with guests and hosting of organisations and events,

5. Your Rights within the scope of KVKK
 
Please note that, as a data subject, you have the rights under Article 11 of the KVKK. 1. Veri Sorumlusu

Kişisel verileriniz, veri sorumlusu hukuki statüsü ile Ay Marka Mağazacılık Anonim Şirketi ("Şirket") tarafından 6698 sayılı Kişisel Verilerin Korunması Kanunu ("KVKK") hükümleri kapsamında ve işbu Üyelik ve/veya Pazarlama Süreçlerine Yönelik Aydınlatma Metni ("Aydınlatma Metni") çerçevesinde işlenmektedir. Kişisel verileriniz, Şirketimiz tarafından tamamen veya kısmen otomatik olan ya da herhangi bir veri kayıt sisteminin parçası olmak kaydıyla otomatik olmayan yollarla, fiziki ve/veya elektronik ortamlardan Şirketimizin https://www.network.com.tr/ ile https://www.divarese.com.tr/ başta olmak üzere internet siteleri, mobil uygulamaları ve elektronik başvuru portalları, fiziki mağazaları, bayileri, çağrı merkezi / müşteri hizmetleri, el terminalleri, telefon, faks, posta / kargo, e-posta, SMS, talep / şikayet platformları, sosyal medya platformları, çevrim içi görüşme / iletişim platformları, Şirket bilişim teknolojileri sistemleri de dahil Şirket içi entegre sistemler ve yetkili kamu kurumları ve özel kuruluşlar ile olan entegre sistemler ve bunlara ileride eklenebilecek sair yöntemler (kanallar) vasıtasıyla toplanmaktadır.

  • İlgili sadakat / kurumsal üyelik programının koşullarına uygun olduğu müddetçe, Üyelik kapsamında sunulan faydalardan / avantajlardan / kampanyalardan / indirimlerden faydalandırılabilmeniz adına gerekli faaliyetlerin planlanması ve yürütülmesi (örn. segment belirleme ve düzeltme, puan kazanımı, segment ve/veya kurumsal üyelik bazlı faydalardan / avantajlardan / kampanyalardan / indirimlerden üyelerimizin yararlandırılması)
  • Müşteri memnuniyeti faaliyetlerinin planlanması ve yürütülmesi (örn. hediye gönderimleri).
  • Organizasyon ve etkinliklerin planlanması, davetli listelerinin belirlenmesi ve davetliler ile iletişimlerin ve organizasyon ve etkinliklerin gerçekleştirilmesi

  • Müşteri kazanımı ve mevcut müşterilerle değer yaratımı faaliyetlerinin yürütülmesi,
  • Üyelik sözleşmesinin kurulması ve ifası kapsamı dışında kalan pazarlama analiz çalışmalarının (örn. profilleme, segmentasyon, veri tekilleştirme, hedefleme, veri zenginleştirme) gerçekleştirilmesi,
  • Kampanya / pazarlama performanslarının ölçümü ve raporlanması,
  • Sosyal medya iletişim ve etkileşim faaliyetlerinin planlanması ve yürütülmesi,
  • Üyelik sözleşmesinin kurulması ve ifası kapsamı dışında kalan reklam, kampanya, teklif, tanıtım, anket, çekiliş, lansman, yarışma, etkinlik, promosyon ve sair doğrudan ve dolaylı kişiye özel / kitlesel pazarlama faaliyetlerinin gerçekleştirilmesi,
  • Ticari elektronik iletişim faaliyetlerinin planlanması ve yürütülmesi,
  • Müşteri memnuniyetini ve deneyimini geliştirmeye yönelik iş birliklerinin yürütülmesi,
  • Pazarlama süreçlerine yönelik denetim ve iç raporlama faaliyetlerinin planlanması ve gerçekleştirilmesi,
  • Saklama ve arşiv faaliyetlerinin yürütülmesi.
  • KVKK’nın 5/1 madde hükmü uyarınca açık rızanın bulunması.

4. Kişisel Verilerinizin Paylaşılması / Aktarılması
 
Yukarıda belirtilen her bir kişisel veri kategorisi kapsamında işlenen kişisel verileriniz, aşağıdaki tabloda belirtilen amaçlarla ve KVKK’nın 8’inci ve 9’uncu madde hükümlerine istinaden kişisel veri işleme şartlarına dayalı olarak aşağıdaki alıcı grupları ile paylaşılabilecektir ve/veya söz konusu gruplara aktarılabilecektir:

5. KVKK Kapsamında Haklarınız
 
İlgili kişi olarak KVKK’nın 11’inci maddesi kapsamındaki haklara sahip olduğunuzu bildiririz. Söz konusu haklarınıza yönelik başvurularınızı, Veri Sorumlusuna Başvuru Usul ve Esasları Hakkında Tebliğ hükümlerine uygun şekilde Şirketimizin gerçek hak sahibi olduğunuzun tespitini gerçekleştirebilmesi amacıyla kimliğinizi doğrulayan bilgilerle/belgelerle* Başvuru Formu vasıtasıyla veya ilgili mevzuatta düzenlenen usul ve esasa uygun şekilde Şirketimize iletebilirsiniz.
